Supreme Court Halts Conviction of Rahul Gandhi in Modi Surname Case

In a relief for the leader of the Congress party, Rahul Gandhi paused his conviction on Friday over the Modi surname. With this, the status of Rahul Gandhi comes as a parliament member that had revoked following his conviction.

If we talk about remarks Gandhi on the Modi surname, a justice bench three-judge, P S Narasimha, B R Gavai, and Sanjay Kumar, said that there are not good taste utterances and that people in public life are supposed to exercise caution when they make the public speeches.

What the court said

The top court said that there is no reason given by the Surat court to impose the maximum aspects on Rahul Gandhi. No reason is given by the judge to impose a maximum sentence, and the conviction order is required to stay pending for final adjudication, said the justice bench. Rahul Gandhi was gone to the supreme court after the high court of Gujarat dismissed the petition in the past month and wanted to put the conviction on hold.

On March 23, the Surat court convicted the congress leader and sentenced him to 2 years. One day later, he is out of the position of MP in Lok Sabha. He represents the seat of Wayanad Lok Sabha in Kerala. Rahul Gandhi challenged the order in session court with a request to pause the conviction. On the other hand, the sessions court granted bail to him on April 20, but it refused to stay the conviction.

What is remarked by the Gujarat High court

During the hearing, the Gujarat Supreme Court remarked on the order for a ” lot of preaching” and ” very interesting read”. He dismissed the petition of Rahul Gandhi in the high court of Gujarat on July 7, observing the purity in politics in an hour of need. Further, the high court said that there was no reason behind pausing the conviction and adding the order to the trial court.

This order was proper, just, and legal, and there was no requirement to interfere with it. The disqualification is not restricted to MLA and MP, said the court. It has been observed by the high court that the public reputation and media coverage of the petitioner’s statements harms the reputation of the Modi community and the complainant.

Plea of Rahul Gandhi in the supreme court

The leader of the Congress, Rahul Gandhi, filed a plea on July 15 in the supreme court. He gave an order to Gujarat high court not to suspend the convictions in a case related to an alleged remark related to Modi’s surname. In the plea, Gandhi urges the top court to suspend the defamation case conviction.

The Parliament member from Kerala’s Wayanad constituency shows that his case is exceptional because of the trivial nature of the offence, with irreparable harm caused by lawmaker disqualification. On July 15, the Supreme Court requested responses from Purnesh Modi, petitioner, and the Gujarat government made an appeal by Rahul Gandhi.
